Welcome to Covers by Kristen! By placing an order with us, you agree to the following terms and conditions. These Terms of Service are designed to ensure a clear and professional relationship between you (the client) and Covers by Kristen/Kristen Lee Design (the designer).

1. Order Acceptance and Right to Cancel

• Covers by Kristen reserves the right to cancel any order at our sole discretion. Should this occur, any payments made for work not yet started will be refunded in full.

2. No Generative AI Usage

• We guarantee that no generative AI tools or software will be used in the creation of your designs. All work is completed using either licensed assets and fonts or created entirely in-house to ensure originality and quality. All licensed assets are checked for AI before licensing.

3. Licensed and Original Content

• All assets, including images, fonts, and other materials used in your design, are either properly licensed for commercial use or custom-created by Covers by Kristen. You are responsible for ensuring you have the appropriate permissions to use the final design in your intended manner. Book covers created using stock may not be used in any way other than as a book cover (i.e for merchandise) - I can invoice for separate, extended licensing but this does not come as standard, unless stock has been custom made for your book cover.

4. Refund Policy

• No refunds will be issued for any orders (except at my discretion), or for premade purchases. If you have purchased a premade book cover that you no longer need, you may sell this cover on with my permission (so long as you do not profit from the book cover).

5. Client Responsibilities

• Clients must provide clear and accurate information about their design needs, including any required specifications, assets, or branding guidelines.
• Delays in communication or providing required materials may result in extended timelines. Due to the nature of my booking schedule, client response delays may cause your order to fall behind another in my queue.

6. Delivery Timeline

• Estimated delivery timelines will be provided upon order confirmation. While we strive to meet these deadlines, unforeseen circumstances may require adjustments. Clients will be notified promptly of any changes.
• If you require an urgent turnaround, a rush fee may apply.

7. Ownership and Rights

• Upon final payment, clients receive the rights to the final design for agreed-upon uses. Covers by Kristen retains the right to use the work for portfolio purposes unless otherwise agreed in writing.
• Book covers, book trailers, character art etc all come with rights to use commercially, except where explicitly mentioned. Twitch emotes (and emotes for other platforms) may be used as emotes, but an additional fee applies to use the emotes on merchandise etc.

8. Limitation of Liability

• Covers by Kristen is not responsible for any indirect, incidental, or consequential damages arising from the use of our designs.

9. Amendments to These Terms

• Covers by Kristen reserves the right to update these Terms of Service at any time. Updates will be posted on our website, and continued use of our services constitutes acceptance of any changes.
